General Terms of Sale

APPLICATION

The General Terms of Sale detailed below apply to all orders placed with PICULUS SARL for the products and services offered on the website www.luminaires-coudert.fr, unless otherwise previously agreed in writing. The present General Terms of Sale are systematically displayed when you place an order. Consequently, placing an order implies the unconditional acceptance of these general terms of sale.

PRICES

Product prices are given in euros, inclusive of taxes. These prices do not include the carriage costs that is calculated automatically and added to your order form (in your shopping cart). Carriage costs are calculated depending on the destination country and the weight of the products ordered. The prices that are guaranteed are those displayed on the website at the time you place your order.

PLACING YOUR ORDER

1. The shopping cart is your order form. 2. You choose to place an order. You must then enter the information required for the invoicing and delivery of your products. The information you supply engages your responsibility. In the event of an error in the delivery address, the website and PICULUS company cannot be held responsible for the failure to deliver your product(s). 3. Confirm your details and choose your payment method. Your order is then confirmed and constitutes an irrevocable commitment on your behalf, which can only be revoked subject to the limitations stipulated in the present general terms (cf. satisfaction guaranteed or refund).

CONFIRMATION OF YOUR ORDER

You will receive confirmation of your order by email. PICULUS reserves the right not to confirm an order for any reason (a problem concerning the order received or a problem with product supply).

MOYEN DE PAIEMENT

Full payment is due when the order is placed. The choice of means of payment is: - by credit card on the website through an secure payment system guaranteed by Société Générale - or by cheque made out to PICULUS Sarl. We only accept checks issued from a French domiciled bank account and your order shipment will take place only after receipt and cashing the check by PICULUS company.

SECURE PAYMENT

PICULUS has opted for a highly secure payment tool (Sogenactif), fully guaranteed by Société Générale. This quality label ensures the complete security of the payment of your online purchases. To pay by credit card, you will be automatically redirected to the Société Générale electronic banking server, which ensures the security of your transactions. PICULUS has no contact nor records of your banking information.

DELIVERY

PICULUS has chosen the postal service Colissimo Suivi of La Poste for product delivery. Delivery will take place within the stipulated time, and for each delivery, the product will be delivered to you direct, in return for your signature on the receipt slip. In every case, you must check the contents and the state of the package you receive before you sign the delivery slip. You must systematically note any litigation concerning carriage (breakage, damage, damaged packaging, missing product, etc.) on the delivery slip. Reservations must be written and sent out by registered letter with acknowledgment of receipt from the carrier within 3 days of receipt of the parcel in accordance with Article L 133-3 of the Commercial Code. If the recipient is absent at the time of delivery, the Postal Service will leave a delivery notice in the recipient’s letterbox. The package should then be retrieved from the nearest post office. Late deliveries will not give rise to damages or interest, withholding of funds, or the cancellation of the order, even in the event of full or partial strikes, internal or external to the company, the blockage of means of transport or supply, or governmental or legal restrictions. PICULUS shall not be held responsible if laws, regulations, or any other event cause your products to be held by customs at a national border. Also, PICULUS will in no way be blamed for facts or problems during transport: destruction, damage, loss or theft ... etc.

If the customer is called upon to dispute the good delivery of the parcel(s) of its delivery, La Poste will then be asked to open a customer inquiry. The inquiry must be opened simultaneously at the request of the sender (Piculus Sarl) and the recipient (the customer). The average waiting time for postal survey conclusions are usually about 2 weeks. The conclusions of the postal survey are proof of the good delivery or loss of the package by La Poste. In that case, Piculus Sarl undertakes to request compensation from La Poste and to return an identical replacement order to the customer. No refund will be granted to the customer until the final conclusions of the postal survey have been issued.

DELIVERY AREAS

Products can be purchased on our website for deliveries in France, Europe and other countries. You should allow 7 to 10 days for delivery within France and 15 days for delivery in Europe or other countries.

RECEIPT OF GOODS

In case of noted defects or deficiencies, it is up to the buyer to provide any justification of them. No return of goods shall be made by the buyer without express prior written approval from Piculus, obtained in particular by fax or email. Return costs will be borne by Piculus only if an apparent defect or missing item is indeed found by Piculus or its representative. The carrier selected by Piculus is the only one authorized to take charge of the return of the goods. After Piculus has noticed an effective apparent defect or missing item, the customer can ask our society its replacement or the delivery of the missing item. However, such an event doesn’t allow the customer to claim any other compensation nor the resolution of the order.

ANNUAL LEAVE

Piculus reserves right of annual closing of the company or of any other kind of holidays or day off, which generally correspond to school vacation. In case of holiday, the orders’ lead time could be longer than usual.

CLAIMS

Claims or disputes will be received kindly and will be handled with attention. In the event of litigation, first contact Piculus to reach a friendly settlement, by explaining the situation in an email to us or by mail to: R&M Coudert – PICULUS Sarl - Customer Service - 59 rue de Prony 75017 - FRANCE. Failing this, any litigation with respect to the interpretation or execution of the present general terms of sale will be the jurisdiction of Paris Commercial courts.

CONFIDENTIALITY

Our company guarantees the confidentiality of any information you communicate to us and we shall refrain from communicating such information to commercial partners without your authorization. In compliance with the “Informatique et Libertés” law dated January 6, 1978 pertaining to Data protection and Civil Liberties, you have the right to access, edit or delete any data concerning you.

INTELLECTUAL PROPRIETY

The website www.luminaires-coudert.fr is the property of the company Piculus Sarl, which holds all rights relating to it. The logo, pictures and images on the website are the property of Piculus. Consequently, it is formally prohibited to reproduce partially or in whole, on any medium whatsoever, the items that make up the website, or to make use of them or make them available to third parties.
